1. Who you are contracting with

These Terms & Conditions ("Terms") govern your access to and use of the Storyseller website and application ("Service"). The Service is operated by David Ransom Paddy (the "Seller", "we", "us"), trading as "Storyseller". By using the Service you agree to these Terms.

2. The Service

Storyseller is a software tool that generates story-based sales email drafts from information you provide (such as a URL, tone, and offer details). You are responsible for reviewing, editing, and deciding whether to send any generated output.

3. Eligibility and accounts

You must be of legal age in your jurisdiction to use the Service. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent, or deceptive;
  • use the Service to send cold, unsolicited, or bulk outbound email. Generated emails may only be sent to recipients who have explicitly opted in to your mailing list (e.g. your newsletter subscribers or existing customers), and you must comply with all applicable email marketing laws including CAN-SPAM, GDPR, CASL, and PECR — including honoring unsubscribe requests and identifying yourself as the sender;
  • infringe intellectual property, publicity, or privacy rights of others;
  • attempt to interfere with the Service's security, probe it, scrape it, or introduce malware;
  • reverse engineer, resell, or redistribute the Service;
  • use the Service to generate illegal content, hate speech, harassment, or deepfakes;
  • jailbreak, bypass safety filters, or misuse the AI features.

5. AI-generated content

The Service uses AI to generate email drafts. You are responsible for the prompts and inputs you submit, for verifying the accuracy of outputs, and for having the rights to any content you input. Outputs may be inaccurate or unsuitable for your use case; they do not constitute legal, financial, medical, or other professional advice. We may remove content, restrict outputs, or suspend accounts that violate these Terms. Rights-holders may contact us at support@storyseller.app to report infringement; repeat infringers may be terminated.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by the Seller and protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. Subject to your compliance with these Terms, you own the outputs you generate for use in your own business.

7. Payment, billing, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.

8. Service level and warranties

We do not guarantee that the Service will be uninterrupted, error-free, or produce any specific business result. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (e.g. fraud, death, or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold the Seller harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your unlawful use of generated outputs.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may export your generated content prior to termination where practicable.

12. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws applicable at the Seller's place of business, without regard to conflict-of-laws principles. Disputes will be subject to the exclusive jurisdiction of the courts of that location, unless mandatory law provides otherwise.
